What is the EU AI Act?

The EU Artificial Intelligence Act (Regulation 2024/1689) is the world’s first comprehensive AI law. It sorts AI systems into risk tiers — prohibited, high-risk, general-purpose (GPAI), limited and minimal — and sets obligations for each.

What makes an AI system "high-risk" under the EU AI Act?

An AI system is high-risk if it is used in an Annex III area — such as hiring and employment, credit and essential services, education, biometrics, critical infrastructure, law enforcement, migration, or justice — or is a safety component of a regulated product. High-risk systems carry the heaviest obligations.

Does the EU AI Act apply to Canadian companies?

Yes. Like the GDPR, the EU AI Act applies extraterritorially — it covers any provider or deployer whose AI system is used by people in the EU, regardless of where the company is based. Canadian companies serving EU users are in scope.

When do the EU AI Act obligations apply?

Prohibited practices and AI-literacy duties have applied since February 2025; GPAI obligations since August 2025; most high-risk obligations phase in through August 2026 and August 2027.

What about AI governance in Canada (AIDA)?

Canada’s Artificial Intelligence and Data Act (AIDA) lapsed with Bill C-27 in early 2025, but a successor is expected and is likely to mirror the EU AI Act’s risk-based approach. Canadian companies that prepare for the EU AI Act now are also getting ahead of AIDA — Valdra tracks both, alongside PIPEDA, Law 25 and CASL.
